SILVER AND GOLD PROJECT DEPOSITS
GoldHearted may require different project-deposit amounts for Silver and Gold projects.
The applicable deposit amount will be disclosed to the customer before payment.
A GoldHearted project deposit is credited in full toward the final purchase price of the approved project.
The deposit is intended to reserve the project and compensate GoldHearted for design and development work once that work begins.
WHEN A DEPOSIT BECOMES NON-REFUNDABLE
Before substantive design work begins, a project deposit may be canceled and refunded.
Once GoldHearted begins substantive design work, including CAD modeling, sculpting, concept development, technical preparation, or other project-specific design labor, the deposit becomes non-refundable.
When reasonably practical, GoldHearted will notify the customer that design work has begun and that the deposit has entered the non-refundable design-work stage.
If a customer chooses to cancel after substantive design work has begun but before production, GoldHearted may retain the project deposit.
IF GOLDHEARTED CANNOT PRODUCE THE PROJECT
If GoldHearted determines that the agreed project cannot reasonably be manufactured as proposed, GoldHearted may offer the customer either:
-
a full refund of the project deposit, or
-
a mutually agreed alternate design of comparable design scope or value.
The customer is not required to accept an alternate design instead of a refund where GoldHearted determines that the original project cannot be produced.
REVISIONS
Custom design pricing includes two reasonable revision rounds unless otherwise stated in the customer's written quote.
A normal revision may include changes such as:
-
modifying a bail,
-
adjusting a small area of the design,
-
proportion changes,
-
minor detail changes,
-
or similar adjustments that remain within the originally approved concept.
After the two included revision rounds, additional normal revision rounds are $100 each, unless GoldHearted agrees otherwise in writing.
REDESIGNS ARE DIFFERENT FROM REVISIONS
A request may be treated as a redesign rather than a normal revision when it materially changes the original project.
Examples include:
-
changing the character or subject,
-
changing a character's pose,
-
replacing the central concept,
-
changing a coin or medallion design,
-
materially changing stone type,
-
materially changing stone layout,
-
replacing major design elements,
-
or substantially rebuilding the composition.
A redesign may require a separate fee and, depending on the amount of new work required, the redesign fee may be comparable to beginning a new design.
GoldHearted will disclose any redesign charge before proceeding with the additional work.
STONE CHANGES
Once a stone selection or stone plan has been incorporated into an approved custom design, stone changes are not treated as minor revisions unless GoldHearted specifically agrees otherwise.
A change in stone type, size, layout, or quantity may require redesign, re-engineering, repricing, or additional material charges.
CAD / DESIGN APPROVAL
The customer is responsible for reviewing the final design carefully before approval.
Approval indicates that the customer accepts the design's visible:
-
overall concept,
-
proportions,
-
layout,
-
subject or character positioning,
-
stone arrangement,
-
bail or attachment configuration,
-
personalization,
-
and other material design features shown in the approval materials.
Once the customer approves the final CAD/design, included revisions end.
Changes requested after approval may require:
-
a redesign fee,
-
additional material charges,
-
additional production charges,
-
a revised production timeline,
-
or a completely new project.
Once manufacturing has begun, GoldHearted may be unable to make further changes.
CUSTOM ORDERS ARE FINAL ONCE PRODUCTION BEGINS
Once manufacturing begins, custom, personalized, engraved, altered, resized, and NameChain orders are generally Final Sale.
This does not eliminate remedies for an item that:
-
arrives damaged,
-
has a verified workmanship defect,
-
is materially different from the customer-approved design,
-
was produced incorrectly because of a GoldHearted error,
-
or is otherwise subject to a non-waivable legal remedy.
PAYMENT BEFORE PRODUCTION AND DELIVERY
GoldHearted may require additional payment before manufacturing begins.
Any required payment schedule will be communicated in the project quote or invoice.
GoldHearted may require the order to be paid in full before the finished jewelry is shipped or released to the customer.
Production does not have to begin until all required approvals and scheduled payments have been received.
CUSTOMER DELAYS
Project timelines may pause if GoldHearted is waiting for:
Any estimated deadline may move accordingly.
If a customer becomes unresponsive for an extended period, GoldHearted may pause the project. When work resumes, a new estimated completion date may apply.
DELIVERY DEADLINES
Dates submitted through GoldHearted forms are requested target dates only.
GoldHearted does not guarantee delivery for birthdays, weddings, holidays, performances, travel, events, or other deadlines unless GoldHearted specifically accepts that deadline in writing.
12-MONTH WORKMANSHIP WARRANTY
GoldHearted provides a 12-month limited workmanship warranty beginning on the confirmed delivery date of the jewelry.
The warranty covers verified manufacturing or workmanship problems such as:
-
clasp failure caused by a manufacturing defect,
-
structural solder or joint failure caused by workmanship,
-
a primary or center-stone setting failure caused by a verified workmanship defect,
-
or another structural issue GoldHearted determines resulted from its manufacturing workmanship.
Where a covered center stone is lost because of a verified covered setting defect, GoldHearted may repair the setting and replace the affected center stone with a reasonably comparable stone, subject to availability and the circumstances of the claim.
GoldHearted may determine the appropriate repair or remedy after inspection.
WHAT THE WORKMANSHIP WARRANTY DOES NOT COVER
The workmanship warranty does not normally cover:
-
melee or accent-stone loss,
-
ordinary scratches,
-
normal wear,
-
expected tarnish or oxidation,
-
gradual finish changes,
-
bent jewelry,
-
stretched or broken chains caused by pulling or impact,
-
accidental damage,
-
crushed or damaged stone settings,
-
chipped or damaged stones caused by impact,
-
improper storage,
-
misuse,
-
chemical exposure,
-
improper cleaning,
-
loss or theft,
-
damage caused by another jeweler,
-
unauthorized repairs,
-
unauthorized alterations,
-
or failure to follow reasonable jewelry-care instructions.
GoldHearted may still offer a paid repair for damage that is not covered by the warranty.
WARRANTY AND REPAIR SHIPPING
Customers must contact GoldHearted before sending jewelry in for inspection or repair.
Do not send jewelry to an address without receiving return/repair instructions.
If GoldHearted confirms that a repair is covered by the workmanship warranty, GoldHearted may provide or reimburse reasonable tracked and insured shipping for the approved repair.
Non-warranty repair shipping and related costs are generally the customer's responsibility unless GoldHearted agrees otherwise.
PAID REPAIRS
GoldHearted may offer paid repair, restoration, stone replacement, refinishing, resizing, or other services after the warranty period or for damage not covered by warranty.
Not every piece can be safely repaired.
GoldHearted reserves the right to inspect a piece before accepting repair work and to decline work that cannot reasonably or safely be performed.
GEMSTONE AND MATERIAL VARIATION
Jewelry is made using natural and/or manufactured materials that can vary.
Natural gemstones may show variations in:
Laboratory-grown diamonds, natural/mined diamonds, moissanite, and other gemstones are separate material categories and will be described accordingly where applicable.
Actual appearance may also vary because of:
Reasonable minor variations are not automatically considered manufacturing defects.
CAD AND RENDER DISCLOSURE
CAD images, 3D models, renders, animations, and digital previews are design and manufacturing representations.
The finished physical piece may show reasonable minor differences resulting from:
A finished item should substantially conform to the approved design, but a digital render should not be interpreted as a promise of pixel-for-pixel visual identity.
JEWELRY WEIGHTS AND DIMENSIONS
Unless expressly guaranteed in writing, published or quoted weights and measurements may be approximate.
Final weight and dimensions can vary reasonably because of material selection, casting, polishing, stone setting, sizing, finishing, and other production variables.
OWNERSHIP OF THE PHYSICAL JEWELRY
After full payment and delivery, the customer owns the physical jewelry purchased from GoldHearted.
Purchasing the physical jewelry does not automatically transfer ownership of GoldHearted's CAD files, 3D models, manufacturing files, technical files, source files, renders, design documentation, or other production assets.
CAD, DESIGN, AND PRODUCTION FILES
Unless GoldHearted specifically agrees otherwise in writing, GoldHearted retains its rights in original GoldHearted:
This does not give GoldHearted ownership of intellectual property that belongs to a third party.
A separate written agreement may be required if a customer seeks exclusivity, confidentiality, or transfer of specific design rights or files.
PHOTOGRAPHY AND PORTFOLIO RIGHTS
Unless GoldHearted separately agrees to confidentiality in writing, GoldHearted may photograph or record the finished jewelry and GoldHearted's own design/manufacturing process and may use that content for legitimate business purposes including:
GoldHearted will not automatically treat customer-supplied private reference photographs as public promotional material.
CUSTOMER-SUPPLIED PHOTOS AND REFERENCES
Reference images uploaded or submitted by a customer may be used by GoldHearted internally for:
GoldHearted will not intentionally publish a customer's private reference photographs for marketing or social-media purposes solely because they were uploaded to a custom-order form.
Where GoldHearted wishes to publicly use customer-supplied reference material, separate permission should be obtained.
THIRD-PARTY INTELLECTUAL PROPERTY
A customer who submits:
represents that the customer has the rights or permission reasonably necessary to request GoldHearted's use of that material for the project.
GoldHearted may:
where intellectual-property concerns arise.
Acceptance of a reference image does not mean that GoldHearted is representing that the requested use is legally authorized.
GoldHearted retains the right to refuse work that it believes may infringe another party's intellectual-property rights or otherwise create unreasonable legal risk.
CUSTOMER ACCURACY
Customers are responsible for reviewing and accurately providing:
GoldHearted is not responsible for an error reproduced exactly from incorrect information approved or supplied by the customer.
If GoldHearted made the error, GoldHearted will work with the customer on an appropriate correction.
FRAUD, ABUSE, AND MISREPRESENTATION
GoldHearted reserves the right to refuse or cancel a custom project where there is evidence of:
-
fraud,
-
payment abuse,
-
identity misuse,
-
intellectual-property abuse,
-
abusive conduct,
-
material misrepresentation,
-
or another legitimate business or legal concern.
If GoldHearted cancels a project for reasons unrelated to customer misconduct after accepting money, any refund due will be determined according to the work completed, materials committed, these terms, and applicable law.
Nothing in these terms limits rights that cannot legally be waived.
GoldHearted Jewelry LLC reserves the right to update these terms prospectively. The terms applicable to a project will be those provided or made available in connection with that transaction, subject to applicable law.
